I don't see how this break the deadlock, the option #3 is the worse option.
It simplify nothing, and is even less logical than the option #1.
A good compromise for me would be to add a field
<configure exist="overwrite" /> so the configuration is overwrote
<configure exist="leave" /> if the node exist, the config is not changed
<configure exist="match" /> an error is returned if config doesn't match
or something similar.
