Agreed. Are you saying that the ABNF needs to be changed in rfc4622bis?
I hope not, because it has been approved for publication.
In any case, the XMPP Registrar can enforce this rule when accepting
registrations for the relevant registry:
http://www.xmpp.org/registrar/querytypes.html
