Any patent used against an application of FOSS software is under OIN, not
just the Linux kernel itself.

Since XMPP is integrated into the popular Linux desktops, Android,
Chromium, etc not to mention many FOSS XMPP clients this should be an easy
case to make if it ever comes up.

Your metaphor of joining the OIN being like joining a nuclear armistice
agreement is spot-on. The most critical area for this is with IoT where
lots of trashy startups have high hopes of locking out competition by
patenting MTI protocol concepts.
